Q

I've just noticed one of my debts is going up even though I'm with Debt Line?

You told me my debts would come down but one of them is increasing every month...

From your 3rd payment onwards, as long as you always pay us on time, your debts should be decreasing.

If your debts are increasing every month this is called "obstruction" and should not be happening while you're in a position of financial hardship.

The Office of Fair Trading Debt Collection Guidance OFT 664 (updated October 2011) gives information about the costs that can be charged for an account.

3.11d states that examples of applying unreasonable charges are:

 - Where there is a charge which is not based on the recovery of actual and necessary costs.

 - Where a debtor evidences they are in financial difficulties and are unable to meet repayments as they fall due and their level of debt would continue to increase if interest and charges continue to be applied.

If you believe you are being obstructed from becoming debt free then make sure you contact us, so we can establish whether this is the case and if so, help you with the process of making a complaint in writing.

Thanks for the help with my complaint. I sent it off this morning, when should I expect to hear back?

Hi Saskia,

The people you owe money to have 28 working days to get back to you. If they haven't, you have the right to send the complaint onto the Financial Ombudsman.

Thanks!
